Abstract

On November 28th, 2008, the Council of the European Union approved a “Framework decision on combating racism and xenophobia”, which has provoked great concern among historians because it is likely to threaten the freedom of research. This framework decision, indeed, not only punishes with one to three years imprisonment racist and xenophobic behaviours(“publicly inciting violence or hatred directed against a group of persons or a member of such a group defined by reference to race, colour, religion, descent or national or ethnic origin, even by the dissemination or distribution of tracts, pictures or other material”), but also opinions which can be the result of historical research:

Le 28 novembre 2008, le Conseil de l’Union européenne a adopté une « décision-cadre pour combattre le racisme et la xénophobie » 1, décision qui inquiète grandement les historiens puisqu’elle pourrait porter atteinte à la liberté de recherche historique. En effet, cette décision-cadre prévoit une peine d’emprisonnement pouvant aller jusqu’à trois ans, non seulement pour les propos racistes et xénophobes (« l’incitation publique à la violence ou à la haine, même par la diffusion ou la distribution d’écrits, d’images ou d’autres supports, visant un groupe de personnes ou un membre d’un tel groupe, défini par référence à la race, la couleur, la religion, l’ascendance, l’origine nationale ou ethnique »), mais également pour des opinions pouvant découler de recherches historiques :
